Terms of use of kampas.be

Article 1 - Scope and purpose of kampas.be

These Terms of Use apply to any use of kampas.be and set out the conditions that apply when accessing and using the Platform kampas.be, creating an Account and making a Booking on the Platform. Each User of kampas.be declares to have taken notice of these Terms of Use (including Privacy Statement) and to accept its content as binding. The Platform kampas.be is owned and operated by Centrum voor Jeugdtoerisme vzw (CJT). With this Platform, CJT wants to play an active role in connecting the demand among youth groups for locations for their multi-day activities and the offer that Landlords have available for this purpose.

In this respect, CJT merely acts as a facilitator and mediator between Landlord(s) and Tenant(s) and is not the provider of the Youth Accommodation. The agreement is therefore made between Landlord and Tenant.

The Youth Accommodation on kampas.be is offered in particular to organisations and private persons with objectives that fit within the framework of the Flemish Government's decree on tourist accommodation or "Logiesdecreet"

Article 2 - Definitions

In these Terms of Use, the terms used are defined as follows:

  • CJT: Centrum voor Jeugdtoerisme vzw, with registered office Bergstraat 16, 9820 Merelbeke (company number 0409.153.027).

  • Youth Accommodation: building(s) and/or terrain(s) offered by the Landlord which, as stipulated in a cooperation agreement between CJT and the Landlord, can be viewed and/or booked via the Platform.

  • Landlord: the natural or legal person who offers a Youth Accommodation via the Platform.

  • Tenant: the natural or legal person acting on behalf of a Group who, after acceptance of the Booking, is the contracting party of the Landlord.

  • User: the visitor of the Platform.

  • Platform: CJT's online service accessible at www.kampas.be through which a Youth Accommodation can be viewed and/or booked.

  • Offer: all Youth Accommodations offered via the Platform.

  • Group: the group of natural persons represented by the User, whether or not as an organisation with legal personality.

  • Stay: the actual use of the Youth Accommodation by the Group as stipulated in the rental agreement.

  • Booking: the reservation of a Youth Accommodation for a Stay by a Group, in accordance with the modalities and conditions indicated on the Platform.

  • Account: the personal environment on the Platform allowing the User to use the services of the Platform.

  • Content: the material posted by the Landlord and/or CJT regarding a Youth Accommodation including, but not limited to, information, photos and hyperlinks.

  • IP Rights: all intellectual property rights, such as copyrights, trademark rights, patent rights, design rights, trade name rights, database rights and neighbouring rights, as well as domain names, know-how and any related rights.

Article 3 – Account

3.1 - The User must create an Account in order to make a Booking via the Platform. He or she must fill in all mandatory information fields.

3.2 - An Account can only be created by persons over the age of 15. Only adult and legally capable persons are entitled to make an online booking with the Account.

3.3 - The User guarantees to provide correct and accurate data when creating and using the Account. The User will not create an Account in the name of or with the details of a third party without their consent. The User is and remains responsible for the accuracy of the completed data, for the confidentiality of the login data as well as for the actions performed with the Account. If abuse of the Account is suspected, the User must report this immediately via info@kampas.be so that CJT can take the necessary measures.

3.4 - CJT has the right to suspend any Account of a User:

  • when incomplete or incorrect information is provided;

  • when one uses another's identity or data;

  • if one or more obligations in these Terms of Use are not complied with;

  • when one abuses the Account and/or Platform (by abuse is meant the use of the Account and/or Platform in a way or for a purpose other than that for which it is intended, in particular: offering Youth Accommodation to organisations and private individuals with objectives that fit within the framework of the Flemish Government's decree on tourist accommodation or "Logiesdecreet");

  • in case of multiple complaints from Groups or Landlords.

  • if CJT has a (other) well-founded reason to do so.

CJT shall not be liable for any compensation in this respect.

Article 4 - IP rights, licence and personal data processing

4.1 - All Content on the Platform is the property of CJT and/or its licensors. It is not permitted to disclose, copy or use the Content without CJT's permission.

4.2 - CJT collects and processes the personal data of the Landlord, User, Tenant and/or Group as described in the Privacy Statement (www.cjt.be/privacy-policy). This is done in a proper and careful manner, in accordance with the applicable laws and regulations, including the General Data Protection Regulation.

Article 5 - Obligations of the Users

5.1 - The User undertakes to use the Platform in good faith, in accordance with these Terms of Use and in accordance with the applicable legal or regulatory provisions.

5.2 - The User undertakes not to enter into any agreements outside the Platform related to the rental of a Youth Accommodation offered on the Platform.

5.3 - The User is prohibited from imitating or appropriating the identity of a third party or violating its IP rights.

5.4 - The User undertakes not to send unlawful, unauthorised, prohibited, racist, xenophobic, defamatory, obscene, offensive, insulting, inappropriate or discriminating statements via the Platform or to post or distribute on the Platform.

Article 6 - Liability and dispute resolution

6.1 - Use of the Platform is at the User's own expense and risk. The User acknowledges and accepts that (technical) problems may occur on the Platform and that (maintenance) works may take place. As a result, the Platform and/or the Account may be (temporarily) slowed down or unavailable and/or cause errors in the Booking. CJT is not liable for any damage (direct or indirect) that the User and/or Group may suffer as a result of the above-mentioned situations, except in the event of intentional act or gross negligence.

6.2 - CJT makes efforts to regularly check and complete the information provided, but cannot be held liable for the accuracy, legality or completeness of the Content, links to the Content and services offered by third parties on the Platform. If there is a suspicion of errors on the Platform, the User may report this to CJT at info@kampas.be so that CJT can take the necessary measures.

6.3 - In case of complaints about a Booking, the Content, the Accommodation, the actions or behaviour of the Landlord or about payments and cancellations, the User, the Tenant or any other representative of the Group may contact CJT at info@kampas.be. CJT or the body mandated by CJT will make reasonable efforts to resolve any disputes. If mediation does not result in an agreement between the Landlord and Tenant or the Group's representative, the Landlord or Tenant may request a judgment from the competent court.

6.4 - CJT cannot be held liable in case of disputes between the Landlord and the Tenant or (the representative of) the Group regarding the execution of the Stay, events during the Stay, guarantees offered by the Landlord, problems related to the Booking and the actions or behaviour of the Landlord.
